1. Acceptance of Terms
By downloading, installing, accessing, or using the DinkedIn mobile application ("App", "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you ("User", "you", "your") and DinkedIn ("we", "us", "our"). Your use of the Service is also governed by our Privacy Policy, which is incorporated by reference into these Terms.
Important: These Terms include a binding arbitration clause and class action waiver in Section 13, which affect your legal rights. Please read it carefully.
2. Service Description
DinkedIn is a mobile platform that connects pickleball players for competitive and casual matches. Our services include:
- Matchmaking: Algorithmic pairing of players based on skill level (MMR), location, and preferences
- Ranking System: MMR-based skill rating and tier-based rankings (Bronze through Champion)
- Venue Integration: GPS-based check-in verification at partner and public venues
- Match Tracking: Automatic recording of match history, statistics, and performance metrics
- Leaderboards: Global and venue-specific rankings
- Social Features: Player profiles, match history viewing, and in-app communication
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.
3. Account Registration and Responsibilities
3.1 Eligibility
You must be at least 13 years old to use DinkedIn. If you are between 13 and 18 years old, you must have your parent or legal guardian's permission to use the Service.
3.2 Account Creation
To use the Service, you must create an account by providing:
- A valid email address, Apple ID, or Google account
- A display name
3.3 Account Security
You are responsible for maintaining the confidentiality of your account credentials, all activities under your account, and notifying us immediately of any unauthorized access.
3.4 Accurate Information
You agree to provide accurate, current, and complete information during registration. Providing false or misleading information is grounds for account termination.
3.5 One Account Per Person
Each user may maintain only one active account. Creating multiple accounts to manipulate rankings, avoid penalties, or for any other reason is prohibited and may result in permanent ban.
4. Acceptable Use
You agree to use DinkedIn in accordance with these Terms and all applicable laws. The following activities are strictly prohibited:
- Cheating: Manipulating match outcomes, falsifying scores, or exploiting bugs
- Harassment: Engaging in harassment, bullying, threats, or abusive behavior
- Fake Accounts: Creating multiple accounts, impersonating others, or using bot accounts
- Location Spoofing: Using GPS manipulation to falsify your location for venue check-ins
- Spam: Sending unsolicited messages, advertisements, or promotional content
- Inappropriate Content: Uploading offensive, sexually explicit, violent, or illegal content
- System Interference: Attempting to disrupt or gain unauthorized access to the Service
- Data Scraping: Using automated tools to collect data from the App without permission
Violation Consequences: Violations may result in warnings, temporary suspension, MMR penalties, rank resets, or permanent account termination, at our sole discretion.
5. Match Conduct and Score Reporting
5.1 Sportsmanship
You agree to conduct yourself with good sportsmanship, arrive on time for matches, complete matches you have committed to, and follow venue rules.
5.2 Score Reporting
Both players are required to report match scores accurately. You must check in to the venue using GPS verification, report the final score truthfully, and resolve any disputes respectfully.
5.3 Disputes
If there is a dispute over match results, both players should attempt to resolve the dispute directly. We reserve the right to void disputed matches or impose penalties for false reporting.
5.4 No-Shows and Cancellations
Repeated no-shows or last-minute cancellations may result in MMR penalties, temporary matchmaking restrictions, or account warnings.
6. MMR and Ranking System
6.1 How MMR Works
Your Matchmaking Rating (MMR) is a numerical representation of your skill level, calculated based on match wins/losses, opponent strength, and match format.
6.2 Rank Tiers
Players are assigned rank tiers based on their MMR: Bronze (0-799), Silver (800-1249), Gold (1250-1699), Platinum (1700-2149), Diamond (2150-2599), and Champion (2600+).
No Guarantees: We do not guarantee any specific MMR, rank, or matchmaking outcome. The ranking system is subject to change to improve fairness. We reserve the right to adjust MMR calculations, reset rankings, or recalibrate the system as needed.
6.3 Integrity
Match fixing, win trading, intentional losing, or any form of ranking manipulation is strictly prohibited and will result in MMR reset, ban from ranked play, or account termination.
7. Intellectual Property
All content, features, and functionality of the App — including software, design, logos, trademarks, and matchmaking algorithms — are owned by DinkedIn and protected by intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.
8. User-Generated Content
You retain ownership of content you create (profile photos, display names, bios, messages). By uploading content, you grant DinkedIn a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content for operating and providing the Service.
We reserve the right to remove any content that violates these Terms or is otherwise objectionable.
9. Disclaimers and Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
We do not guarantee availability of opponents, quality of matches, accuracy of user information, or behavior of other users.
Physical Activity: Pickleball is a physical activity that carries inherent risks of injury. You participate in matches at your own risk. Consult a healthcare professional before engaging in physical activity if you have health concerns.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DINKEDIN SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES arising from your use of the Service, including loss of profits, data, or injuries sustained during matches.
IN NO EVENT SHALL DINKEDIN'S TOTAL LIABILITY EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNT YOU PAID TO DINKEDIN IN THE PAST 12 MONTHS.
11. Indemnification
You agree to indemnify and hold harmless DinkedIn from any claims, liabilities, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or your conduct in matches.
12. Termination and Suspension
You may terminate your account at any time using the "Delete Account" option in app settings or by contacting us. We reserve the right to suspend or terminate your account for violation of Terms, abusive activity, or prolonged inactivity (12+ months).
Upon termination, your access ceases and your data may be deleted per our Privacy Policy. Sections 7, 9, 10, 11, and 13 survive termination.
13. Dispute Resolution and Arbitration
PLEASE READ CAREFULLY. THIS AFFECTS YOUR LEGAL RIGHTS.
You and DinkedIn agree that any dispute shall be resolved by binding arbitration, rather than in court, except claims in small claims court or equitable relief for IP infringement.
Arbitration will be conducted by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration will be held in Travis County, Texas.
CLASS ACTION WAIVER: YOU AND DINKEDIN AGREE THAT EACH MAY BRING CLAIMS ONLY IN YOUR INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE PROCEEDING.
Before filing arbitration, you agree to first attempt informal resolution. You may opt out within 30 days of accepting these Terms by sending written notice.
14. Governing Law
These Terms shall be governed by the laws of the State of Texas, United States. Any disputes not subject to arbitration shall be resolved in the state or federal courts in Travis County, Texas.
15. Changes to Terms
We may modify these Terms at any time. When we make material changes, we will update the "Effective Date", notify users via push notification or email, and display a notice in the App. Your continued use after changes constitutes acceptance.
